Default notification emails

To date we have been unable to set up email notifications to "ON" by default. If anyone can find the place/way to change those settings please let me know.
Regarding questions on if it's allowed: "Yes, of course it's legal to have email notifications on by default for people who actively choose to sign up to a forum. Some forums are even email-first as basically an email discussion list but still have a forum view on a website as the alternative." - Aaron Wolf
